Welcome to the website ("Site") for Dancat Communications, Inc. (Dancat) and Dr. Hartman’s Virtual College Counseling Center (“VCCC”). This User Agreement, including our Privacy Policy, governs your use of the Site and the Dancat products.
End-User License Agreement for the “Virtual College Counseling Center or VCCC ("Client")
PLEASE READ THIS DOCUMENT CAREFULLY BEFORE FIRST USING THE CLIENT. THIS AGREEMENT PROVIDES IMPORTANT INFORMATION CONCERNING THE CLIENT; PROVIDES YOU WITH A LICENSE TO USE THE CLIENT, AND CONTAINS WARRANTY AND LIABILITY INFORMATION.
1. Notice
This Client is for personal use only. The Client, or any output from it, may not be used for commercial, educational or government purposes or to use the Client on multiple computers at the same time. Licensing information for those purposes is available by contact DanCat Communications at: info@kenhartman.com
2. License
This Agreement allows you to use the Client with the following restrictions: Unless DanCat Communications, Inc. has authorized you to distribute the Client, you may not make or distribute copies of the Client or electronically transfer subscription permission and user information to another person. The Client is for personal use only. The Client, or any output from it, may not be used on multiple computers or for any commercial, government or educational purposes. You may not decompile, reverse engineer, disassemble, or otherwise reduce the Client to a human-perceivable form. You may not modify, rent, resell for profit, distribute or create derivative works based upon the Client.
3. Ownership
This license gives you limited rights to use the Client. You do not own the Client. DanCat Communications, Inc. retains ownership of the Client and all content contained therein. All rights not specifically granted in this Agreement, including Federal and International Copyrights, are reserved by DanCat Communications, Inc.
4. Disclaimer of Warranties.
DanCat Communications, Inc. makes no warranty of any kind with respect to the accuracy of the Client. DanCat Communications, Inc. specifically disclaims all warranties, express, implied or otherwise, including without limitation, all warranties of merchantability and fitness for a particular purpose.
This Client may contain links to sites on the Internet owned and operated by third parties. DanCat Communications, Inc. is not responsible for the availability of, or the content located on or through, any such third-party site. Information in this document is provided "as is," without warranty of any kind, either expressed or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose and freedom from infringement. The user assumes the entire risk as to the accuracy and the use of this document.
5. Limitation of Damages
DANCAT COMMUNICATIONS, INC.SHALL NOT BE LIABLE FOR ANY SPECIAL, INCIDENTAL, INDIRECT OR CONSEQUENTIAL DAMAGES OF ANY KIND, OR ANY DAMAGES WHATSOEVER RESULTING FROM LOSS OF USE, DATA OR PROFITS, WHETHER OR NOT ADVISED OF THE POSSIBILITY OF DAMAGE, AND ON ANY THEORY OF LIABILITY, ARISING OUT OF OR IN CONNECTION WITH THE USE OR PERFORMANCE OF THIS DATA OR THE DANCAT COMMUNICATIONS, INC.
7. General
This Agreement shall be governed by the internal laws of the State of New Jersey. This Agreement contains the complete agreement between the parties with respect to the subject matter hereof, and supersedes all prior or contemporaneous agreements or understandings, whether oral or written. DanCat Communications, Inc. and “Everything Parents and Students Need to Know About the Road to College” , as well as “Virtual College Counseling Center” , “VCCC”, “After School Tips for Parents” and “College Counseling Webinars” are trademarks of DanCat Communications, Inc or The National Technology Institute for School Counselors.
Please read this User Agreement carefully, because by visiting or using the Dancat Site or the Dancat products, you agree to follow the Dancat rules and terms of use. From time to time we may modify these rules and terms of use. We will provide notice of any significant change by posting a notice on our home page. Your continued use of the Site and the Dancat products after any modification indicates your agreement to the new rules and terms of use.
Privacy Policy
Please review our Privacy Policy, which is a part of this User Agreement and describes how Dancat handles any personally identifying information collected from visitors to the Site.
Termination
We reserve the right to suspend the Site or your use of the Site or terminate this User Agreement at any time without notice for any reason, including, in the case of the User Agreement, for your violation of any of its provisions. The Disclaimer and Limitation of Liability and Governing Law sections of this User Agreement shall survive any such termination.
WEBSITE PRIVACY POLICY
Dancat Communications, Inc. (Dancat) takes your privacy seriously. We know you trust us to help with your college admissions process and we want you to know that you can trust us with your personal information.
We need to collect some personal information from you to set up your account with us. Here are some of the things we need your personal information to be able to do:
We May Share Your Personal Information For Safety Reasons
If we have reason to believe that disclosing your Personal Identification is required by law, or is otherwise reasonable to protect someone from possible injury, we may do so. Transfer to the United States If you are located outside of the United States, please note that the personal data you provide to us will be transferred to the United States. Whenever you submit any personal data to us, you consent to this transfer.
Cookies
Cookies are files that your Web browser puts on your computer when you visit a Web site. We use cookies to tell us how often you visit our site, and what pages you go to on our site. The cookie itself does not have personal information in it, so no one except Dancat can figure out who you are from our cookie. Sometimes we use files from other companies (called third-party cookies) to help us see where people go on our website, to improve our services. Dancat is concerned with the security of your personal data. To keep that data secure, we restrict unauthorized access through protective policies, procedures, and technical measures. Terms and Conditions to accept before confirming purchase of Dancat’s VCCC
If I change my mind after the first 30 days of service, will notify Dancat via email (support@kenhartman.com) and my payment will be partially refunded and my log in will be deactivated. Please allow up to 6 weeks for refunds to be processed. By accepting the terms of the User Agreement, I understand and acknowledge the following:
